This interdisciplinary book of essays addresses critical issues arising from the emergence of legal institutions in contemporary China. One section of the book focuses on the legal process: how law is mobilized by ordinary people to redress injustice, the role of legal culture, the extent to which citizens can sue state officials, and how disputes involving workers and veterans are settled. A second set of papers explores specific legal institutions, such as the security apparatus, “labor reeducation” camps, and rules that punish infringement of intellectual property rights. Almost all the contributors are social scientists who have recently engaged in field research in China. The introduction by the editors and the individual chapters attempt, for the first time, to bring to bear on the study of Chinese law the law-and-society scholarship that has enriched Western legal studies in recent years.

A Tough Study

Let me give full disclosure here - I struggled mightily with this book for a graduate-level class. That said, the struggle was worthwhile in the sense of coming to terms with some issues in the discussion of "collective memory" and the way people's perceptions of the past evolve and change over time. The individual chapters of the text are pretty straight forward, to be honest, but trying to sort out a general thesis for the text is much more challenging. Still, by looking at sites as diverse as Berlin, New York and South America, Huyssen offers a way to consider how memory and history come together to build a sort of public identity. Certainly not for the casual reader, but for a history student, this should probably almost be a required read.

Drawing on long-term ethnographic research with the Yonggom people of New Guinea, the author examines how indigenous analysis organizes local knowledge and provides a framework for interpreting events, from first contact and colonial rule to contemporary interactions with a multinational mining company and the Indonesian state.

This book highlights Yonggom participation in two political movements: an international campaign against the Ok Tedi mine, which is responsible for extensive deforestation and environmental problems, and the opposition to Indonesian control over West Papua, including Yonggom experiences as political refugees in Papua New Guinea. The author challenges a prevailing homogenization in current representations of indigenous peoples, showing how Yonggom modes of analysis specifically have shaped these political movements.

While ethnography ordinarily privileges anthropological interpretations, this book attempts the reciprocal process of describing indigenous modes of analysis. Drawing on long-term ethnographic research with the Yonggom people of New Guinea, the author examines how indigenous analysis organizes local knowledge and provides a framework for interpreting events, from first contact and colonial rule to contemporary interactions with a multinational mining company and the Indonesian state.
This book highlights Yonggom participation in two political movements: an international campaign against the Ok Tedi mine, which is responsible for extensive deforestation and environmental problems, and the opposition to Indonesian control over West Papua, including Yonggom experiences as political refugees in Papua New Guinea. The author challenges a prevailing homogenization in current representations of indigenous peoples, showing how Yonggom modes of analysis specifically have shaped these political movements.

About the Author
José van Dijck is Professor of Media and Culture at the University of Amsterdam. She is the author of several books, including Manufacturing Babies and Public Consent: Debating the New Reproductive Technologies (1995) and ImagEnation: Popular Images of Genetics (1998). I recommend the book

I enjoyed reading the book, and as the previous reviewer noted, van Dijk certainly did her homework. The topic is of interest for me because, generally, it aims at brining technologies and the material sphere unto issues that are usually labelled abstract or psyche-something - like personal memories. Also, I have written about medium theory and wanted to see the transition the author discusses from analog media (specifically visual media or photos) to digital ones. So in all these respects it's interesting and clearly written and I will use one of its chapters as one of the introductory pieces for my Media and Material Culture class. My own interests and preferences are a. more critical (neoliberal, commercialization and control of images and their production, copyright and distribution), 2. More on public issues and the public sphere, and less of an emphasis on autobiographical and personal memory. Although I know that these are overlapping - if not indistinguishable – and I guess that this is the point I am trying to make. 3. finally, and as part of a more critical rendering, I’m interested in gender and what van Dijk has to say about this. Where there is a discussion of ‘family’ and of ‘autobiographical’ images, it seems to me to always ask for suspicious about gender and visual rights and restrictions pertaining to women.

How technology is changing memory

José van Dijck raises interesting questions in this book: How are digital artifacts different from physical ones? What does the advent of zero-cost memorabilia mean for how we construct our identities? How will this technological transition affect our culture and our sense of history?

These are good questions to reflect on, but this book gives us few answers. There are some enjoyable (and potentially illuminating) stories in here; my favorite is of the radio station in The Netherlands plays "the two thousand most popular songs of all times" (the subject of Ch. 4). Unfortunately, these stories are interspersed with unparseable sentences such as "In conjunction to the technological script, we hence need to look at how social practices and cultural forms transpire through the concrete manifestations of diary writings and lifelogs" (p.67) and "The pair brain/mind is hierarchically off set from the pairs technology/materiality and cultural practices/forms; the latter two are mere conceptual aids in the neurobiological theory of movies-in-the-brain" (p. 125).

Clearly, van Dijck has done her homework. But can any amount of social theory shed light on such broad questions? After reading this book, I don't feel like I've gained any new insight beyond the traditional mantra of the humanities: It's complicated.

In each of these areas, he lays out the most important rules and concepts in the Islamic juristic tradition, and then gives his translations of a selection of Ebu's-suud's writings on the topic in question, with a brief analysis. From these materials, the author suggests that readers draw their own conclusions as to whether Ebu's-suud did indeed reconcile Ottoman secular legal practice with the sacred law.

The jurist Ebu’s-suud (c. 1490–1574) occupies a key position in the history of Islamic law. For forty years, he held the senior judicial position in the Ottoman empire, most of this time serving under the Sultan Suleiman I, known in the West as “the Magnificent.” The Ottomans, however, remembered the Sultan as “the Lawgiver,” emphasizing that it was above all the legal order of his reign that they admired. The central figure of this order was Ebu’s-suud.
The Ottoman concept of the ideal law was traditional Islamic law, the shari ‘a. However, the problem was that the shari ‘a was in many respects impractical and had always, of necessity, coexisted with secular systems of law. An Ottoman tradition, which began in the seventeenth century and which modern historians often reiterate, asserts that during the reign of Suleiman I, Ebu’s-suud succeeded in harmonizing the secular law with the shari ‘a, creating, in effect, a new ideal Islamic legal system.

This way of presenting the material is done for two reasons. The first is that Ebu’s-suud’s texts (which are inaccessible to most people, either linguistically or because they exist only in manuscript) are made available in translation, so that readers can agree or disagree with the author’s conclusions. The second reason is to present a wide array of previously unavailable sources to encourage further research in the study of Islamic and Ottoman law, demonstrating that the careful, detailed examination of these and other related sources can illuminate important areas of Ottoman law and Islamic history.

Bourdieu Breaks It Down

Much as Edmund Husserl was always writing an "Introduction to Phenomenological Philosophy", French sociologist Pierre Bourdieu produced many introductions to his 'logic of practice': this is the last and, I think, the best. Although Bourdieu, in keeping with his self-image as a man compelled to reveal social reality by careful scientific study of that reality, did many worthwhile "special studies" of sociological topics his insistence on continually updating his "reflexive sociology" shows that he was no 'felicitious positivist' -- and the actual mechanics of this explanation of how human beings travel like pachinko balls in carefully constrained if seemingly random social trajectories are one of the glories of 20th century social theory. Bourdieu was intent on being the most materialist of cultural materialists, denying the reality of social transcendence through values and "the finer things", and all these books are Baedekers for people bombing in life.

The titular conceit is an interesting one: Bourdieu claims he took for a time to calling himself a Pascalian when people would ask if he was a Marxist, and the actual words of the famous mathematician, philosopher, and theologian appear quite frequently throughout the book. There is none of the famous "wager", however: what Bourdieu is inspired by are statements in the line of "habit is ten times nature". Bourdieu's own concept of "habitus", a word liberated from premodern philosophical ethics in order to capture the sense in which our sociocultural make-up 'makes our decisions for us' while we unwittingly persist in an image of ourselves as free and unconstrained agents, is naturally illustrated by the reference-point. Beyond that, a concept under-described in his other books, the "social field", is carefully explained as the matrix of social vectors which -- as Bourdieu famously and, surprisingly, truly said -- makes even the 'life chances' of a artistic genius, no less than a journeyman in a craft.

Admittedly, some of the asides are 'B-sides': Bourdieu essentially calls Juergen Habermas a poorly disguised theologian, completely ignoring Habermas' careful work with the modern philosophical tradition and its relevance for social theory, and his observations about the relative isolation in which American elite education occurred throughout the 20th century are no longer apposite after the "urbanist" turn of the US creative class. But for the most part, as displayed in *Sociology is a Martial Art* -- the film documentary made in the last years of his life -- Bourdieu stayed in close contact with French social reality and much of what Anglophones forget Europeans understand about success and failure is a prosaic guide to social sanity. Additionally, the frustratingly idiosyncratic printing techniques of Bourdieu's other works -- paragraphs of Bourdieu's set in 'block quotes' which lead the reader to expect a quotation when one is reading the main text -- do not irritate here.

Not easy. But necessary.

I think for me this book filled a gap. A big gap. Between current, or in any case, recent philosophy (i.e. postmodernism) and sociology. Bourdieu even motivates that the existence of that gap was his main reason for writing the book. How is the gap filled?

What I've found is a valuable contribution that remains theoretical, engaged, yet practical in its application. Valuable, because it contributes to an increased engagement of theorists with practice. Valuable also, because there are some basic starting points derived from theoretical issues that Bourdieu pushes forward, irrespective of domain to which these issues belong.

If you're wondering what specifically those issues are, I'm sorry to have to disappoint you. I've read the book too long ago to remember. I'm writing this, because I'm very surprised nobody has reviewed it yet. This book is much too valuable to leave unreviewed. I.m.h.o. it's a very powerful theoretical contribution to increasing sensible scientific practice. Read it!

Pioneer Photographers Of The Far West 1840-1865 is an impressive and unique compendium of some 1500 photographers, retouchers, printers, manufacturers and sellers of photographic instruments and stock, publishers, lithographers, and engravers who were active in western North America prior to 1865. Enhanced with around 250 illustrations (many of them published here for the first time), this meticulously researched and scholastically rigorous biographical reference is a definitive, exhaustive, authoritative, and documented contribution to the study of the early years of photographic history in general, and photography as it was first introduced to the western frontier in particular.

A Remarkable Work

Seldom is a work of historical significance of such magnitude written in our generation. The pages come alive with the exquisite prose of Mr. Kailbourn. Tales of those that have come before us are given a new breath of life. This is a tome that all serious students of history should have under their mantles. This is a book that should be placed each night near the pillow as one sleeps. Enough with that Harry Potter twit and how many more letters of the alphabet must Sue Grafton exploit before we shall rise up and say no more. Well then say no more and order this book. P.S. Any relationship between this reviewer and the author is not a coincidence.

A great reference book and a very interesting read as well. Good illustrations and well written. A good addition to my library. I wish there was another in the set to cover western photographers thru to 1900.
