About the Author
Erwin Chemerinsky is the Alston & Bird Professor of Law and Political Science at Duke University. In July 2008, he will become the founding Dean of the Donald Bren School of Law at the University of California, Irvine. He is the author of four books, including, Federal Jurisdiction (2003) and Constitutional Law: Principles and Policies (2002). He frequently argues appellate cases, many in the United States Supreme Court.

The Nutty Professor

"Enhancing Government!?" Frightening! Sounds like a low-budget, late-night infomercial for inadequate men. Chemerinsky (Chimera-in-Sky) is no Alan Dershowitz. Rather, he is a prime example of the phenomenon of an intelligent man who chooses to be out of touch with reality. Chimera-in-Sky seems to despise the Constitution. For Chimera-in-Sky, the Constitution is simply an old document to be overcome by activism and emotional arguments for social justice and "change." If Chimera-in-Sky and his ilk had an ounce of decency, integrity and intellectual honesty, they would seek to amend the Constitution in order to carry out their social objectives, as the document itself prescribes. Instead, in light of social "emergencies, such as racism, poverty, inequality, etc., they seek to "empower" the courts and government by using expedient methods and openly lying about what the Constitution states and means, and what the limits of each branch of government are. No signer to the Constitution could have imagined the monstrous, all-powerful, totalitarian government allowed by our courts. Rather than proceed through the legislature, as required, totalitarian ideologues like Chimera-in-Sky seek to continually corrupt the entire judicial system just to prevail on a few social issues. Thanks to fake professors, lawyers and judges like Chimera-in-Sky, the real Constitution has been gutted. The 9th and 10th Amendments, that would have protected the People from wild, cancer-like government and ongoing abuses of power, have been ignored. If you must buy Chimera-in-Sky's nonsense book, you can get it used on Amazon for around six bucks. Or you can buy Mein Kampf or Stalin's Dialectical and Historical Materialism and to learn about similar totalitarian methods. I truly pity students who must endure Chimera-in-Sky's nonsense.

Chemerinsky is thoughtful and deeply knowldgable. The ideological reviews in thisbook are sloppy and unwarranted.

reducing the role of the legislature

The author advocates the court system's writing law instead of being the arbiter. The author appears to believe that courts can make all decisions by broadly referencing the Constitution. In the extreme, the authority of elected legislatures would be dramatically diminished. I found his point of view frightening in his willingness to so dramatically tamper with the balance of powers of our system
